US Supreme Court Slams Door on Lawsuits Against Tech Companies for Overseas Abuses

The case centers on Cisco Systems, the networking giant. Followers of Falun Gong—a spiritual movement brutally suppressed in China—tried to sue Cisco in US courts, alleging the company knowingly sold surveillance technology to Chinese authorities who used it to monitor, arrest, and torture them. Heavy stuff: basically, helping an oppressive regime do its worst.

But the Supreme Court said nope. The ruling narrowed the Alien Tort Statute (ATS), a 230-year-old law that previously let foreign victims sue American companies in US courts for crimes against humanity committed overseas. Now the Court says the company's connection to the crime has to be direct—almost impossibly so. Just selling something you know will be weaponized isn't enough anymore.

For Cisco, it's a massive win. For victims of abuse? Not great. The ruling means that even if an American company deliberately supplies technology to a brutal regime that uses it to torture, it's vastly harder—possibly impossible—to sue in the US. You'd have to try in the country where the abuse happened instead. And if that country is either powerless or complicit, well, good luck.

The justices didn't deny Cisco knew how its technology would be used. They just said it's not legally "complicit" enough under American law. It's like saying: yes, you knew, yes, the outcome is horrific, but technically it's not our problem. Refraining from evil isn't legally mandatory, at least not in a US courtroom.

The vote was 6-3, with the three dissenters essentially screaming theft. Their argument: the law existed precisely for these situations, and the majority gutted it. Hard to argue they're wrong if you think about the Falun Gong practitioners being tortured.
